Got an email today from Greg Damis of Prudential Fox & Roach regarding the Lead Based Paint Poisoning Prevention Bill proposed by Blondell Reynolds Brown.  This proposal is laughable at best,  most notably because the very homes that would benefit the most – Section 8 and HUD homes – are exempt.

ATTENTION ALL PROPERTY OWNERS:

The LEAD PAINT BILL is scheduled for enactment by the full City Council on Thursday. After the powerful appearance and excellent testimony by a great many HAPCO members and other property owners, beneficial amendments to the bill were introduced.

HOWEVER, FURTHER AMENDMENTS ARE STILL REQUIRED

YOUR TESTIMONY IS CRITICAL

            The law as proposed still APPLIES TO EVERY RENTAL PROPERTY whether occupied by children or not. You can testify about any aspect of the proposed law that you wish but we are focusing our efforts on two amendments which have the best chance of incorporation into the bill.  The first paragraph below is our primary interest.

  • REQUEST OF THE COUNCIL THAT THE BILL APPLY TO PROPERTIES WHERE CHILDREN 6 AND UNDER RESIDE. The bill should NOT APPLY to every rental unit. Stress that there will be no “discrimination against families” in refusing to rent to them; that the economics of the rental market requires that you rent to families, especially single family homes; and that owners are law-abiding. APPLYING THE LAW TO EVERY RENTAL UNIT WILL CAUSE SIGNIFICANT and UNNECESSARY EXPENSES which will be PASSED ON TO THE TENANTS, or cause you to be unable to continue providing housing. Properties can cost tens of thousands of dollars to make “lead safe”. To spend those sums on properties where children do not reside will have a devastating effect on private property in the city.
  • REQUEST THAT COUNCIL DESIST FROM OVERLY HARSH PUNITIVE MEASURES-  in this case BE FAR IN FINES: $2,000 for an offense is overreaching; offenses can be innocent. The attempt to set such an exorbitant level of fine is unfair.

PROCEDURE- YOU MUST REGISTER TO SPEAK

            Call ASAP to the call the Chief Clerk’s office at 215-686-3410 or 215-686-3411. If you have not called to sign up by 5 pm on the Wednesday before the Council session, you should sign up in Room 400 City Hall before the Council session starts.

The Public Comment at the full City Council is more restricted than the committee; the 3 minute rule is more strictly applied. The time goes fast- try to get your points in right away and within the time limit.

CONTACT THE COUNCIL MEMBERS BEFORE THE MEETING

CALL CITY COUNCIL MEMBERS and LEAVE SHORT MESSAGES REQUESTING THAT THE LEAD BILL BE AMENDED TO APPLY TO PROPERTIES WITH CHILDREN.
